Question on store shipping/insurance policy * final update post 10*

Can a store do this?

I paid by paypal but forgot to add insurance as its been months since I bought at this store and I forgot that they say they are not responsible for packages unless you buy the insurance. There was no were that it says this except in their shipping policies and the place to buy insurance isn't obvious on the page.

Package got lost for a week and didn't update on the DC#. I emailed the store owner and they said they couldn't do anything about it as I hadn't purchased insurance but would give me a 25% off coupon.

Thankfully the DC# updated today but if it hadn't would I still be able to file with paypal and win?? (I might need to if items are damaged).

I always thought insurance was up to the seller not the buyer.

According to Paypal rules, you are correct. The seller is responsible for intact delivery of the item. I do know that Paypal rules usually trump individual store rules as well. If the store uses Paypal as a checkout service, they are abiding by Paypal's rules and have to abide by them.

They can say whatever they want in their policies but if they're using Paypal Paypal's TOS will trump that. The seller is responsible for ensuring that a package arrives to the buyer. Even in the USPS loses a package, it's still on the seller according to PP.

I recently had USPS lose one of my packages and I remade the order. For my business, if I can't afford to replace/refund an order I get insurance and consider it a business expense.

Something to consider,

Would you rather pay for insurance if you want it or have the store have to increase shipping prices to automatically include insurance?
Shipping prices went up this year and insurance is expensive. Yes, it gets written off as a business expense but it still adds to the bottom line.

I would rather pay the $2-3 more to have insurance included than have to search for an insurance listing or email the business to have it included.

Thanks everyone. I thought it was the seller's responsibility and that is why I include it in my shipping costs for my business (and let customers know this). It looks like it will be delivered to me either today or tomorrow.

Got them today and 1 is damaged (it was 3 bottles of wool wash). She didn't package them well and one of the tops on a flip top bottle came off and everything leaked out and got all over everything. Should I call paypal to see if I'm covered for her not packaging them well as I believe she will say I'm SOL without the insurance.

I would contact her first anyway. She should know her packaging was poor, even if she doesn't want to refund your money or replace the item. If she values her customers, however, she should apologize and replace the item at her cost. I know we can't out the biz here, but I'm getting curious to know who is handing out 25% off codes instead of providing real customer service.

I contacted her and it looks like she is going to fix it as it is her mistake. I also just noticed that one of them is the wrong scent (monkey farts instead of unscented) which is a problem for me as I can only use unscented.

Well she fixed it better than I thought she would (full refund for my total order). I'm not sure if I will order there again though even with this
